Each person MUST read and understand this waiver and liability release before participating in club activities.
1. By signing this document, I confirm that I am the person named below and that I have read and that I understand this waiver and liability release.
2. I understand that this waiver and liability release is provided for the benefit of Golf Saint-Donat and each of its directors, officers, employees, volunteers, coaches, officials, business operators, agents and owners or occupants of the site property (collectively called the “Organization”).
3. I understand that there are inherent risks (“Risks”) associated with each of the following activities (“Activities”):
• The sport of golf,
• The use of golf equipment and/or electric carts, whether rented or purchased from the Organization, or owned by me,
• Use of the Organization’s facilities, and
• Participation in sporting activities, like conditioning, training, catering and other activities, services, programs or events offered or planned by the Organization.
4. I am aware that risks include, but are not limited to, the risk of serious injuries, death or property damage. I understand that risks may be related to my own state of health (including physical, mental and emotional) and to the level of awareness, care and skill in which I conduct myself.
5. I freely accept and assume full responsibility for all risks and possibilities of injuries, death, property damage or other losses resulting from my participation in the activities described above. I accept these risks and agree to the terms of this waiver and liability release, even if the Organization is found to be negligent or in breach of any duty of care or obligation to me as a result of my participation in the activities.
6. In addition to the consideration given to the Organization for my participation in the activities, I and my heirs, next of kin, executors and trustees (collectively called “legal representatives”), agree:
• To waive any and all claims that I have or may have in the future against the Organization;
• Release and forever discharge the Organization from any and all liability for any bodily injuries, death, property damage or other losses resulting from my participation in the activities for any reason whatsoever, including, but not limited to, negligence (the failure to use such care as a reasonable and prudent person would use in similar circumstances) whether passive or active, breach of any obligation imposed by law, breach of contract or error of judgment by the Organization;
• Release and forever discharge the Organization from all liability for any bodily injuries, death, property damage or other losses resulting from any infectious disease, virus, bacteria or other micro-organism (whether asymptomatic or not); or
• Release and forever discharge the Organization from any liability for any bodily injuries, deaths, property damage or other losses resulting from the Coronavirus (COVID-19), including any mutation or variation of the latter; or
• Release and forever discharge the Organization from all liability for any bodily injuries, deaths, property damage or other losses resulting from a pandemic or epidemic, as declared as such by the World Health Organization or any governmental authority, and
• Be responsible for and hold harmless and indemnify the Organization from and against all actions, proceedings, claims, damages and interest, costs, demands, including court costs and legal fees, as well as liabilities of any nature whatsoever arising out of, or in any way connected with, my participation or that of my guests in the activities.
7. I agree that this waiver and responsibility discharge, and all conditions contained herewith, shall be governed by the laws of the province or territory of Canada in which the activities take place. I hereby irrevocably submit to the exclusive jurisdiction of the courts of such province or territory. Any litigation to enforce this waiver and release must be filed in the province or territory where the activities take place.
8. I confirm that I have had sufficient time to read and understand each section of this waiver and liability release in its entirety, and I have freely and voluntarily accepted the terms. I understand that this waiver and discharge legally binds me and my legal representatives.
